COOKIES AND WEB BEACONS

In accordance with Law 34/2002, of 11 July, on information society services and electronic commerce (LSSI), in relation to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, General Data Protection Regulation (GDPR) and Organic Law 3/2018, of 5 December, on Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), it is mandatory to obtain the express consent of the user of all websites that use non-essential cookies before they browse them.

WHAT ARE COOKIES AND WEB BEACONS? 

Cookies and other similar technologies, such as local shared objects, flash cookies or pixels, are tools used by web servers to store and retrieve information about their visitors, as well as to ensure the proper functioning of the site.

Cookie: A data file that is stored on the hard drive of a user’s computer or electronic communications device when browsing a specific website, which allows status information to be exchanged between that site and the user’s browser. The status information may act as a means of session identification, authentication or reveal user preferences, as well as any data stored by the browser regarding the website.

Web Beacons: A visible or hidden image inserted into a website or email, which is used to monitor user behaviour on these media. These objects allow information, such as the source IP address, browser used, operating system, date on which the page was accessed, and, in the case of email, the association of the above data with the recipient, to be obtained.

These cookies, web beacons and/or similar technology are needed for the basic functioning of the website. The use of these devices allows the web server to remember certain information about the user, such as their preferences for viewing the pages on that server, their name and password, the products that interest them most, etc.

COOKIES AND BEACONS AFFECTED BY REGULATIONS AND EXEMPTIONS

As per EU directives, cookies and beacons that require informed consent from the user are analytical cookies and advertising and affiliation cookies, with the exception of technical cookies and those necessary for the functioning of the website, or the provision of services expressly requested by the user.

TYPES OF COOKIES 

ACCORDING TO PURPOSE

• Technical and functional cookies: these allow the user to navigate through a website, platform or application and use the different options or services that exist therein.
• Analytical cookies: these allow the person responsible for them to monitor and analyse the behaviour of users of the websites to which they are linked. The information collected through this type of cookie is used to measure the activity of websites, applications or platforms and to create browsing profiles of the users of these sites, applications and platforms, in order to introduce improvements based on the analysis of the usage data performed by the users of the service.
• Advertising cookies: these allow the most effective management of the advertising spaces that, where applicable, the publisher has included on a website, application or platform from which the requested service is provided, based on criteria such as the content edited or the frequency with which the advertisements are displayed.
• Behavioural advertising cookies: these collect information about the user’s personal preferences and choices (retargeting) to enable the most effective management of the advertising spaces that, where applicable, the publisher has included on a website, application or platform from which it provides the requested service.
• Social cookies: these are set by social media platforms in services to allow you to share content with your friends and networks. Social media platforms have the ability to track your online activity outside of the Services. This may affect the content and messages you see on other services you visit.
• Affiliate cookies: these allow visits from other websites with which the website has an affiliate agreement (affiliate companies) to be tracked.
• Security cookies: these store encrypted information to prevent the data stored in them from being vulnerable to malicious attacks by third parties.

ACCORDING TO OWNERSHIP

• First-party cookies: these are sent to the user’s device from a computer or domain managed by the publisher itself and from which the service requested by the user is provided.
• Third-party cookies: these are sent to the user’s device from a computer or domain that is not managed by the publisher, but by another entity that processes the data obtained through cookies.

ACCORDING TO THE RETENTION PERIOD

• Session cookies: these are a type of cookie designed to collect and store data while the user accesses a website.
• Persistent cookies: these are a type of cookie in which the data remains stored on the device and can be accessed and processed for a period defined by the cookie controller, which can range from a few minutes to several years.
